SHOULD I TALK TO LAW ENFORCEMENT IF I’M BEING INVESTIGATED FOR OR HAVE BEEN CHARGED WITH A CRIME?

Law enforcement often want to interview those they have accused of committing crimes. Sometimes, they try to get those they have accused to admit guilt. While you should be cooperative with law enforcement to avoid any additional charges, if police want to interview you and discuss an incident, you should ask to speak with an attorney prior to that meeting. WHAT IS A “DISCOVERY” AND HOW CAN I OBTAIN MINE?

The discovery process is when a criminal attorney will obtain the evidence the prosecution has gathered. This evidence may include anything from witness statements, police reports and records, and other relevant information about the case. WHAT CRIMES CAN’T BE SEALED?

Many crimes are eligible to be sealed in Colorado and many are not. Class 1 and 2 felonies, level 1 drug felonies, violent crimes, unlawful sexual behavior-related crimes, class 1 and 2 misdemeanor traffic offenses, DUIs and DWAIs, class A and B traffic violations or infractions, crimes involving extraordinary aggravating circumstances and risk are some of the many crimes cannot be sealed in Colorado. However, Governor Jared Polis recently signed the Clean Slate Act into law. This law allows arrest records that did not result in a conviction and certain older criminal records to be automatically sealed. WHAT IF I WASN’T READ MY MIRANDA RIGHTS WHEN I WAS ARRESTED? CAN MY CASE BE DISMISSED?

An officer not reading your Miranda Rights when you were arrested does not guarantee your case will be dismissed. These rights being read and explained to you are to protect your Fifth Amendment right to refuse to answer any self-incriminating questions. If an officer fails to read you these rights and proceeds to question you, the court may find any findings as a result of that questioning unlawful.
